"The boss isn't here, ask someone else."

The registered trainer is permanently absent and no one else takes care of things.

§ 28 BBiG / § 30 BBiG

The boss may NOT do that
The trainer must be personally + professionally + pedagogically qualified and present!
Anyone who trains must be personally and professionally suitable (§ 28 BBiG); professional suitability includes vocational and work-related teaching skills, usually proven by the trainer aptitude exam (AEVO, § 30 BBiG). The company must carry out the training itself or expressly appoint a trainer (§ 14 (1) no. 2 BBiG) — one who is practically never there does not meet that. The IHK/HWK monitors suitability (§ 32 BBiG) and can object to shortcomings; in serious cases the responsible state authority can prohibit training (§ 33 BBiG).

What the law says

§ 28 BBiG – Personal suitability
Anyone who hires or trains trainees must be personally suitable. Personally unsuitable is in particular anyone who is not allowed to employ children and young people.
§ 30 BBiG – Professional suitability
Professionally suitable is anyone who possesses the vocational skills, knowledge and abilities as well as the occupational and work-pedagogical skills.
§ 32 BBiG – Prohibition
The competent body must prohibit the hiring and training of trainees if the personal or professional suitability is lacking.

What you can do

  1. Record the dates + hours during which no trainer was available.
  2. In place of the trainer: has the company named a "training instructor"? If not, there is a clear gap.
  3. Involve the IHK training advisor — they check the suitability.
  4. In case of a permanent deficit: a change of training company may be possible.
