Sickness
"With us you need a sick note from day one."
You are ill for a day and are supposed to get a doctor's note for that.
§ 5 Abs. 1 EntgFG
This is allowed
Yes, the company may require that.
You must report illness to the company without delay, i.e. on the first day, ideally before work starts — the company decides how (usually by phone). By law a medical certificate is only needed from the fourth calendar day, but the employer may require it earlier, even from the first day (§ 5 (1) EntgFG). Since 2023 there is the electronic sick note (eAU): the doctor certifies the incapacity, and the company retrieves it from your health insurer. Your part is to see the doctor in time and inform the company. If the rule applies only to you, no special reason is required, but it must not be harassment.
What the law says
§ 5 (1) EntgFG – Duty to notify and prove
The employee must report incapacity for work and its expected duration without delay. If it lasts longer than three calendar days, a medical certificate must be provided; the employer may demand it earlier.
What you can do
- Report before work starts — even if you are only going to the doctor afterwards.
- Say how long you expect to be away; you do not have to give a diagnosis.
- On school days, also inform the school according to its rules.
- Keep the printouts of the eAU for your records.
